Terms of Service

1. Acceptance of Terms

By accessing or using MagicPixel ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

MagicPixel is an AI-powered pixel art editor for creating, editing, animating, and managing game-ready pixel art assets. Features include AI generation, an inventory system, an asset marketplace, and an integration API for paid plans.

3. Accounts & Authentication

You may create an account using email and password or Google OAuth. You are responsible for keeping your credentials secure and for all activity that occurs under your account.

4. Subscriptions, Credits & Billing

MagicPixel offers monthly subscription plans (Hobby, Indie, Studio) and one-time credit packs, billed via Stripe. AI generations consume credits based on the model used. Unused subscription credits roll over up to a maximum of 2× your monthly allocation. You can cancel anytime via the Stripe customer portal; access to paid features continues until the end of the current billing period. Credits already consumed are non-refundable.

5. Content Ownership & License

You retain full ownership of all content you upload, import, create, or generate using the Service, including AI-generated outputs. MagicPixel does not claim ownership of your content or generated assets.

By using the Service, you grant MagicPixel a limited, non-exclusive, worldwide, royalty-free license to host, process, store, display, transmit, and reproduce your content solely to operate, improve, secure, and support the Service for you. This license includes the right to send your prompts and reference images to third-party AI providers (such as Google) as necessary to produce outputs, and to store and display outputs through the Service. This license continues until you delete the content or your account, and may survive deletion for a limited period as required for backups, legal compliance, or operational integrity.

Free trial accounts. Pixel art generated during a free trial may be made freely available to the MagicPixel community, including in public galleries, marketplace listings, or promotional materials. By generating art during a free trial, you grant MagicPixel a perpetual, worldwide, royalty-free license to display, distribute, and promote those assets for community and marketing purposes.

Paid accounts. Assets created or generated while on a paid subscription are entirely private and protected. We will not display, distribute, or use your paid-account assets except as needed to operate the Service for you.

6. User Representations

You represent and warrant that:

  • You own all rights to any content you upload, import, or submit to the Service, or you have obtained all necessary permissions, licenses, and rights from the rightful owner.
  • You will not upload, import, or use any content you do not have permission to use.
  • You are solely responsible for the prompts, reference images, style references, and any other inputs you provide to the Service.
  • You are solely responsible for your use of any generated output, including reviewing it for accuracy, appropriateness, and compliance with applicable law before using it commercially or otherwise.
  • Your use of the Service and any generated outputs will comply with these Terms, all applicable laws, and the terms of any third-party services used by the Service (including Google AI terms).

7. Marketplace

Sellers listing assets on the marketplace warrant that they own or have the rights to distribute the content. Sellers grant buyers a non-exclusive license to use purchased assets in their own projects. MagicPixel retains a 20% platform fee on each sale; the remaining 80% is paid out to the seller.

8. Acceptable Use

You agree not to use the Service to:

  • Upload, generate, distribute, or sell content that infringes any copyright, trademark, trade secret, or other intellectual property rights.
  • Create unauthorized derivatives, replicas, counterfeit works, or other content that misappropriates third-party rights.
  • Generate or distribute illegal, infringing, hateful, harassing, defamatory, fraudulent, or sexually explicit content involving minors.
  • Abuse, scrape, reverse engineer, or overload the AI generation, API, or other systems.
  • Attempt to bypass usage limits, security controls, or access restrictions.

We may suspend or terminate accounts that violate these terms.

9. AI Generation Disclaimer

AI outputs are probabilistic. MagicPixel does not guarantee the uniqueness, accuracy, quality, or fitness of generated content for any particular purpose. Similar or identical outputs may be generated for other users, and outputs may not be unique.

We do not warrant that any generated output is free from third-party intellectual property rights or other restrictions. You are responsible for reviewing AI-generated assets before using them in your projects and for ensuring your use complies with applicable law and the terms of any third-party AI providers (such as Google) used by the Service.

10. API Keys & Integration

API access is available on paid plans. The official MagicPixel CLI (@magicpixelart/cli) and Vite plugin (@magicpixelart/vite) authenticate with the same API keys to sync assets into your project. You are responsible for keeping your API keys confidential. Keys can be revoked at any time from your account settings. Abuse of the API or CLI may result in suspension.

11. Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted availability and may modify, suspend, or discontinue features at any time.

12. Limitation of Liability

To the fullest extent permitted by law, MagicPixel is not liable for any indirect, incidental, special, or consequential damages, including loss of data, profits, or AI generation results. Total liability is capped at the amount you paid us in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless MagicPixel, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your content, your use of the Service, your breach of these Terms, your misuse or distribution of generated outputs, or any infringement or violation of third-party rights.

14. Copyright Complaints

MagicPixel respects intellectual property rights. If you believe content on the Service infringes your copyright, please notify us through the Feedback option in the app (Help menu). Your message goes directly to the MagicPixel team.

Your notice must include:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing and where it is located on the Service.
  • Your contact information, including address, telephone number, and email.
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

If you believe your content was removed in error, you may submit a counter-notice containing your contact information, identification of the removed material, a statement under penalty of perjury that you believe the removal was a mistake, and consent to the jurisdiction of the appropriate federal court.

We reserve the right to remove content, disable access, and terminate or suspend accounts of repeat infringers in response to valid complaints.

15. Termination

You may delete your account at any time from Settings, which removes your data from our active systems. We may terminate or suspend accounts that violate these terms.

16. Changes to Terms

We may update these terms periodically. Continued use of the Service after changes constitutes acceptance of the updated terms.
